All this would be very easily solved by banning algorithmic recommendations or at least mandating pluggable algorithms with a sane default that doesn’t prioritise rage bait over everything else.

So if you build a system that allows mass abuse of power through surveillance then that’s who you are and that’s the purpose of the system you built. No much point arguing about intent. What happens is they do defer to the expert. The expert is a plant by which ever lobbiest chose to sponsor the bill.
