  • So tactically, if one or two of the group go first, the rest get to see a preview of most of the body of evidence that will be used against them. If there’s any weakness in the presented case, they can craft their defense around it.

The defendant has a constitutional right to have access to all evidence that will or could be used against them, as well as any exculpatory evidence the prosecutor might have.

So if there’s a tactic, it’s not to be able to see the evidence to improve their legal defense, it’s to be able to spin the evidence to the public in the coming months to try to get Trump elected or rile the mob enough for people to try another J6.

  • Based on what she says in this video, because the umpire on the field didn’t indicate that he was safe because of being pushed off the base, the replay officials considered that they were to determine if the player was ever off the base and being tagged, because the push off rule is a judgement call and can’t be challenged.

If that’s the case, then the Guardians are penalized because the umpire on the field made that technical mistake, which is exactly the whole purpose of replay in the first place.

Hopefully umps can learn from this and be sure to indicate that the player is safe because of the push-off rule to avoid it being challenged and overturned, which will prevent the tackling/intentional push tactic from becoming normalized. But stuff like this is just so unfortunate for baseball.
