A federal judge on Friday ruled that immigration officers in Southern California can’t rely solely on someone’s race or speaking Spanish to stop and detain them.

District Judge Ewusi-Mensah Frimpong issued a temporary restraining order after a lawsuit was filed by three men who were arrested as they waited to be picked up at a Pasadena bus stop for jobs on June 18, and after two others were stopped and questioned despite saying they are U.S. citizens.

Frimpong’s order bars the detention of people unless the officer or agent “has reasonable suspicion that the person to be stopped is within the United States in violation of U.S. immigration law.”

    If they were getting due process this would matter more.

    I assume ICE can just start shipping immigrants out of their local areas to other detention facilities and use the LA facility for immigrants not living in that district.

    Oh, well, speaking as an enthusiastic Nazi, whenever they have the wrong skin color or talk funny, or have a wierd last name, I just make up some bullshit charge I think they might have done. Then I get the desk jockey dork to write me up a more technical and plausible version of that bullshit for when I have to go talk to you.

      Reasonable suspicion does have a specific legal definition.

      You are right that it’s not a magical shield or protection in the moment. It would matter in court but that would be well after the fact and, as we’ve all seen, would just give ICE time to play their shell game.

        Yeah, they can just do whatever the fuck they want in the mean time, cops rarely ever get stopped by a ‘reasonable suspicion’ standard, which is much, much, muuuuuuch more lenient than an actual ‘probable cause’ standard.

        Like here’s how reasonable suspicion works:

        We are looking for a brown guy.

        We were near his apartment complex and saw a brown guy roughly matching his description go into an apartment.

        This guy is wanted for… whatever made up bullshit immigration violation… so, we have ‘reasonable suspicion’ that that was the brown guy we were looking for, going into, i dunno, maybe his neighbor friend’s apartment, maybe his, who cares, thus we are justified in breaking down the door.

        And no, no it won’t matter in court, its been a year and a half, brown guy died in GITMO or CECOT or Alligator Auschwitz 3 months before this case brought by his remaining US family actually got before and judge, and even if the ICE agents are found guilty, whablamo, Trump pardons them.

    There isn’t even a war declared, but this seems like it’s all about getting a case to the SCOTUS so that this batch can return Korematsu v. United States to its 1944-2017 status as allowing racial profiling.

    In scientific terms all dogs are Canis if they can fuck and make other dog…now replace Canis with human and call that a species within a genus. Realize that the Dutch and the Japanese can have babies if they just fuck for once. Dutch, Japanese, Mexican etc, those are nationalities and are all meaningless scientifically and biologically. “Hispanic” another bullshit term like African American or people of color.

    I would prefer to be called by my name, my pronouns or at least “that guy over there”. There’s a reason I migrated to this country. This country offered “better”. So all you gotta do is be honest and open about it…

      I hear this point raised somewhat frequently, and I understand the sentiment, but it’s just incorrect. There are physical and genetic differences between different groups of people from different parts of the world. We are all human and all deserve respect, but I think papering over our differences and declaring we’re all the same introduces an unnecessary level of doublethink to the discussion.

        So as you can imagine, my kids who are born from a father of one nationality and a mother from another nationality across the globe have no “race” or “ethnicity” both of which are social constructs and are not genetic or scientifically relevant terms… And we’re brown. As soon as anyone mentions those terms in a conversation my brain tells me to walk away. When my kids were born, an island nation didn’t suddenly pop up mid Atlantic… Or more accurately, a freaking land ring did not appear. They cannot be deported to anything where they came from except for the USA. They don’t have specific eye features that tell anyone they come from New York. No Jaw bone spurs that only appear in native SanDiegans (L-O-fucking-L).

        Literally, the city I was born in is twice as old as the US and people from my country funded her country… Only hundreds of years ago. The time between the roman empire and now is not significantly long to create a human sub species. So from a scientific logical person to the rest of y’all, forget these terms and anything else as such. Say “a person born in Arizona was murdered by a gov agency today”. That’s much more accurate.

                My point is merely that there are population clusters with genetic differences. It’s incorrect to say that we are all human, therefore scientifically we are all the same. In aggregate, the people of Japan are not the same as the people of Ireland. (This paragraph makes zero claims about individuals; it is scoped to large groups of people.)

                I just want to clarify that I’m not claiming that “race” per se is a thing, nor am I claiming that there are any mutually-incompatible human species. I’m not attempting to say anything about nationality, country borders, or deportations. The political madness happening in the USA is truly disgusting. I am deeply saddened by the cruelty and hatred that’s on display.

The differences you mention as genetic can only be those that separate one person from another for example hair color, eye color, height, etc. All those localized differences don’t exist in the US because they are only sustained by having populations that rarely migrate. So when you visit Mexico and you’re the tallest guy in a huge crowd some of that comes from what you eat and some from your unique makeup as an individual. However our gene composition is all the same and only the various phenotypes change.

    his order does no good since the cop can claim terry stop which gives the officer the ability to make up a reasonable suspicion which includes anything

      In California a Terry stop also requires reasonable articulable suspicion of having committed a crime. That means they can’t conduct a terry stop based on their feefees. They need some sort of evidence, and this judge just ruled that their bigotry, xenophobia, and racism aren’t “reasonable articulable suspicion“.
